Welcome to www.thecruisestore.co.uk. The Cruise Store is a trading name of Going Places Leisure Travel Limited (ABTA K1943) who act as agents on behalf of licensed tour operators. These Terms of Use apply to your use of this site and is a legal document which sets out your rights and obligations in relation to the holiday services offered through this site (the 'Holiday Services'). www.thecruisestore.co.uk is a new website through which you may book Holiday Services where we act as agent for the following leading tour operators (the relevant 'Operator' as appropriate):

'We', 'us' or 'our' means Going Places Leisure Travel Limited trading as The Cruise Store.

EU Directive - Carriers & Community List In accordance with EU directive (EC) no. 2111/2005, Article 9, we are required to bring to your attention the existence of a 'Community list' which contains details of air carriers that are subject to an operating ban within the EU Community. The Community list can be found on the Department of Transports website www.dft.gov.uk by following the links from the Aviation page through to Foreign Airline Permits via the Aviation section.

1. Agreement

By accessing, using, browsing or booking on this site you agree that you have read, understood and agree to be bound by these Terms of Use and you agree to comply with all applicable laws, rules and regulations.

Any holiday or other service you purchase using this Site will constitute a legal agreement between you and the relevant Operator. The Cruise Store is an agent through which Holiday Services are made available to you but we are not responsible for your holiday. Please note that in order to book Holiday Services on this site you will be required to accept the relevant Operator's Booking Conditions. The Booking Conditions form the legal contract between you and your Operator and govern the terms on which Holiday Services are offered and sold on this Site.

Nothing in this site shall constitute an offer of goods or services. No contract shall be formed between you and your Operator until you have received confirmation that your Operator has accepted your booking.

2. Who can buy holidays through www.thecruisestore.co.uk?

This Site and its Holiday Services are only available to people who, and parties that may, lawfully enter into and form contracts under UK law and under the booking conditions of the relevant Operator. In general you must be aged 18 years or more to book a Holiday Service from this Site and there must be at least one adult (18 years or more) travelling on any one booking. However it is a condition of some Operator's booking conditions that passengers under 21 years of age must be accompanied by a parent, guardian or chaperone who is at least 25 years of age. And that all guests under 18 must share accommodation with one guest aged 21 or over. Alcohol will not be served to guests under 21 on certain cruise lines. 3. Late deals

If you have booked near the departure date then tickets will not be sent out to you by post. You can collect them instead from the Operator's ticket desk at your departure airport. There will be a nominal charge for tickets on departure and the exact amount will depend on your chosen Operator and will be notified to you at the time of booking.

All accommodation ratings shown are the relevant Operator's own rating - they may be different to the accommodation's official rating. Ratings also differ between Operators.

4. Variation of Terms of Use

These Terms of Use may be revised from time to time. If they are revised, we will post the revised version on this Site. The revisions will be effective immediately. Please re-read these Terms of Use from time to time even if you have previously used this Site. By using this Site after we have changed the Terms of Use, you will be deemed to have accepted the changes. If, for any reason, you do not agree to abide by our Terms of Use, please do not use this Site.

5. Changes to Site

Further, we may change this Site at any time without notice by adding or removing discounts, late deals, holidays and other features or services. This will be without liability to you. We reserve the right to withdraw offers and discounts at any time and at our discretion. We do not warrant that the information accessible via this Site is accurate and assume no duty to update such information. The information which we display is derived from a number of sources including the Operators and Revelex and we accept no liability for the accuracy of such information. Please check all details with your Operator or us before making your booking. We do not accept liability for any errors or omissions.

6. Price

The prices of holidays and flights displayed in search results are in Pounds Sterling (£) and are subject to availability. Each Holiday Service includes all relevant Air Passenger Duty and Aviation Security Fees. There may be arrival or departure taxes payable in your chosen holiday destination which will be extra. The system will show the latest range of holidays available within your search criteria. This information is supplied direct from the Operators' booking systems and so prices are live but subject to availability. Insurance is extra and must be purchased at the time of booking. You may choose from our insurance or if you already have insurance cover of a comparable cover and give us your details, this will be accepted instead. Please read section 7 below on Insurance.

Please note: We charge no booking fee for this service. We charge no debit card fees but we do charge a 2% credit card charge fee.

All prices displayed are based upon the lowest cabin type available and maximum share basis. Fewer passengers travelling may result in under occupancy supplements being charged.

Abbreviations
There is a range of abbreviations used by tour operators, a selection shown below:

HB = HALF BOARD
FB = FULL BOARD
AI = ALL INCLUSIVE
MP = MEAL PLAN
FO = FLIGHT ONLY


Arrival and Departure Taxes These are not included in the price of your holiday and are payable at your destination airport. These are frequently subject to change at short notice by local authorities. Please check the up-to-date position with us before you book.

Foreign Office Travel Advice The Foreign and Commonwealth Office issues and frequently updates advice for those travelling outside the UK. The advice includes general warnings and specific information for the benefit of travellers. Please check the up-to-date position with us before you book or alternatively you can access latest information from the Foreign and Commonwealth Office Travel Advice Unit on Ceefax or Prestel, or on the FCO Website at www.fco.gov.uk.

Requests
If you need special assistance or have any medical requests, we strongly advise you to call us before you book so we can check with your selected Operator to avoid disappointment. Your requests will be noted but unfortunately we cannot guarantee them.

Ratings
All tour operators use their own rating system, which may not be the same as the official star rating.

Tickets
Wherever possible, tickets will be despatched 14 days before departure unless advised of ticket on departure. If you have not received your tickets then please call our customer services advisors on 01254 350993.

Receipts
All receipts and invoices refer to the 24-hour clock. Arrival and departure times stated are local.

Car Hire
All drivers of hire cars need to produce a valid driving license on collection of their car. Different rules can apply in different countries such as age restrictions and insurance recommendations.

Ages
The age of a child is determined by the age on the date of return. Travel can be refused if the correct child age has not been disclosed.

Passports

IT IS YOUR RESPONSIBILITY TO BE IN POSSESSION OF A VALID PASSPORT AND ANY VISA THAT MAY BE NECESSARY. BE CERTAIN TO APPLY IN TIME AS IN THE ABSENCE OF VALID DOCUMENTATION, YOU WILL NOT BE ALLOWED TO TRAVEL.

Advice for British Citizens

For travel outside the UK, British Citizens need a valid full ten-year passport. Some countries require a minimum passport validity of up to 6 months. Please call 0870 5210410 for more information or visit www.ukpa.gov.uk.

Advice for Citizens of Other EU Countries, Citizens of Non-EU Countries and Holders of British Subject Passports.

EU nationals and non-British Citizens must contact the Embassy/Consulate or High Commission for advice on passport requirements. For more information visit www.ukpa.gov.uk.

Visas
Some countries require nationals of other countries to apply for visas before they are granted entry. There may be a need for a visa if your stay exceeds 3 months. For more information contact the Foreign and Commonwealth Office on 0207 2384503 / 4504 or visit www.fco.gov.uk.

If you fail to obtain the relevant documentation and vaccinations before you travel you will be solely responsible for any costs, loss or damage which you, we or the relevant Operator incurs as a result of that failure. We shall not be liable for any such costs, loss or damage.

Vaccinations
You must ensure you have had all applicable vaccinations before you travel. For up to date information please check the department of Health Leaflet T5 or consult your local doctor.

You should note there are no compulsory requirements for travel to any Western Europe or North American destination, nor for travel to Malta. Customers travelling to other worldwide destinations should check the up-to-date position with us before you book.

Insurance
All parties travelling need to be adequately insured and it is generally a condition of the Operator's booking conditions that you have adequate insurance to be able to book a holiday with them. We offer a fully comprehensive policy although if you have your own then they will need written confirmation within 48 hours of booking. It is inadvisable to travel without insurance and we accept no responsibility for anyone who does not book adequate insurance. Payment
A deposit is payable at the time of booking which will vary by Operator. All balances will be collected 12 weeks before departure. If you have paid your deposit by credit, debit or switch card you will need to contact us on 01254 350993 to confirm the balance due to be debited from your card when it falls due. 8. The Cruise Store Price Match Guarantee

    The Cruise Store guarantees that we will match any advertised price if you let us know before making your booking.*

    * This Price Match guarantee is only applicable to bookings that can be made through a travel agent, agent call centre or agent website. It does not apply to any special offers, discounts or other limited promotions offered by that travel agent. All elements of your chosen holiday must match.

    Price guarantee comparisons will be based on the same cruise ship and itinerary (including any stay if applicable), cabin/room type, board basis, duration, flight route and seat class, day and time of departure, transfers, insurance and any other elements comprising your chosen holiday booking.

    You should obtain a written quotation from your travel agent and show that to us before making your booking with The Cruise Store.

    This Price Match Guarantee only applies to comparable holidays booked with third parties. Therefore this does not apply to the same holiday available through The Cruise Store at a later date if it should be advertised at a lower price. This Price Match Guarantee excludes any group offers or charters.

    The Price Match Guarantee only applies to the purchase of package cruise holidays which include a cruise, flight, transfer and customer insurance.

    You can book with The Cruise Store 24 hours a day, 7 days a week.

    The Cruise Store is the first UK retailer to offer customers the opportunity of booking a cruise 24 hours a day, 7 days per week via our fully bookable website.

    If you experience an issue on your cruise which cannot be resolved on board then call our Duty Office 24 hours a days, 7 days a week and we will do our very best to help in any way we can*.

    * Customers will be liable for the costs of calls made from the ship. Customers are also advised to approach the Cruise line staff first with their issues prior to contacting the Duty Office.

9. Satisfaction Guarantee

With our Satisfaction Guarantee if you book your cruise through The Cruise Store, we guarantee you will experience an excellent cruise or your money back*.

If, within 24 hours of boarding your cruise ship, your holiday is materially different from the description, and any amendments advised to you, and you have not been able to resolve this with the Operator, then at the next port of call we will arrange for you to be transferred to your port of embarkation and help arrange your flight home. We will also refund the unused portion of your cruise holiday, e.g. if you are on a 7 night cruise and you are flown home on day 2, then you will receive a refund of the equivalent cost of 6 days of your cruise.

* Terms and Conditions

This Guarantee only applies if there is a material difference between the description of what you booked and what you receive. The description of what you book will include any amendments that we have advised you prior to departure. "Material" means something significant onboard the ship which cannot be remedied within 24 hours. E.g. if you have booked an outside cabin and you are provided with an inside cabin due to an overbooking. Situations such as those caused by force majeure e.g. a change of itinerary due to bad weather or port closures, or illness e.g. sea sickness, do not constitute "material differences".
You must make a formal complaint to the Operator as soon as you become aware of the issue, and in any event you must report this within 24 hours of boarding the cruise ship.
At the next port of call, we will transfer you to your port of embarkation. We will pay for your transfer to the airport or to the relevant port (Please note the next port of call may not necessarily be the following day.)
We will help arrange your flight home. Bear in mind that all flights are subject to availability and you may not necessarily be able to fly home that same day. If you have to stay on shore, then we will pay for your accommodation which will not be of a lower standard than the cruise ship. This will be on a full board basis.
We will pay for your flight home by scheduled or charter flight (economy class) subject to availability.

We will not be liable for refunding any car parking or other incidental expenses incurred by yourselves should you chose to return home early.

We will refund the unused part of your cruise holiday comprising the unused cruise days and your flight costs.

We will be able to deduct amounts we pay you under this Satisfaction Guarantee from any compensation the Operator pays you.

10. Law and Jurisdiction Every booking shall be deemed performed in the United Kingdom. This site is not intended for use in jurisdictions outside the UK. English law shall govern each of the bookings made through us, including (without limitation) all contractual and other relationships which arise out of such bookings. You and we each submit to the exclusive jurisdiction of the English Courts in relation to any disputes arising out of any booking. If however you have booked your holiday in Scotland or Northern Ireland any disputes may be dealt with in the local Courts in Scotland or Northern Ireland and will be subject to the law of those countries. Alternatively (if your Operator is a member of ABTA) you may choose to have your dispute resolved through the ABTA arbitration scheme. Full details are set out in your Operator's Booking Conditions.

11. Data Privacy
We will respect the privacy of your data which you supply to us in accordance with our Privacy Policy.
We will comply with all applicable data protection legislation in respect of it. You agree to keep your data accurate and up to date and promptly to send us any new or revised personal data. You further agree that we may use your personal data in the ways advised in our Privacy Policy.
It is your responsibility to keep your passwords confidential and use the security devices offered. Our security measures depend on you complying with this obligation and we are not responsible for any breach of your privacy due to your failure either to keep your passwords secret or to use the other security devices correctly. Nor are we responsible for breaches of security arising out of intentional and/or unauthorised attempts to access the site, for example, by computer hackers. All calls will be recorded or monitored for training purposes.

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, home address, e-mail address, credit card number and any special needs/disabilities/dietary/religious requirements or any medical information etc.

We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as your tour operator, cruise lines, airlines, hotels, transport companies etc. The information may also be provided to your insurers (if you apply for insurance), security or credit checking companies, public authorities such as customs/immigration if required by them, for debt collection purposes, by internet service providers or as required by law.

Additionally, where your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in this country. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. When making a booking, you consent to this information being passed on to the relevant persons.)

Usually your tour operator or other principal will pass this information onto their suppliers once we have provided it to them. The tour operator or other principal's use of your information is subject to their policy, both in respect of your booking and any future marketing and is their responsibility. Please ask us or them for a copy of this if you would like to see it.

If you have booked a holiday you will still receive an email confirming your booking details and even if you have exercised your right to opt out of further communication as these are necessary to process your booking.

How do we protect your information?

When you provide us with your credit card details or order services from us, we offer the use of a secure server. The secure server software encrypts the information that you input before it is transmitted to us.

We have strict security procedures covering the storage and disclosure of your information in order to prevent unauthorised access to comply with the UK Data Protection Acts of 1984 and 1998. This means that sometimes we may ask for proof of identity before we disclose personal information to you.
